1. Definitions

1. 1.1. Goods – electronic book reading devices (e-readers), accessories for e-readers, electronic content (electronic copies of literary works (books and other literary works), audio works, software, etc.), and other tangible assets presented and available for purchase via the Website.
2. 1.2. Buyer – an individual who has placed an order to purchase the Goods via the Website.
3. 1.3. Seller – the person who sells the Goods to the Buyer based on the Buyer’s order placed on the Website.

2. General provisions

1. 2.1. This Agreement is a public offer to conclude a sales contract for the Goods under the terms of an adhesion contract. The Agreement is drawn up in accordance with Articles 633, 634, 641, 642 and Chapter 54 of the Civil Code of Ukraine and has full legal force.
2. 2.2. Acceptance of the Agreement terms by the Buyer is confirmed by the fact of placing an order on the Website when ordering the Goods.
3. 2.3. By agreeing to the terms of this Agreement, the Buyer confirms their legal capacity and competence.

3. Subject of the Agreement

1. 3.1. Under this Agreement, the Seller undertakes to sell the Goods to the Buyer according to the assortment available on the Website, and the Buyer undertakes to accept and pay for the ordered Goods under the terms of the Agreement.

4. Terms of purchase and payment for the Goods

1. 4.1. Acceptance by the Buyer of the offer to conclude this Agreement is carried out by the Buyer performing the following actions:
   × visiting the Seller’s Website;
   × selecting a specific Product from those available at the time of the visit;
   × reviewing the terms of this Agreement;
   × placing an order to purchase the Goods.
   When placing an order, the Buyer provides the Seller with the data necessary to fulfill the order, namely: the Buyer’s first and last name (and/or the recipient authorized by the Buyer), email address and/or contact phone number, delivery address or details of the Nova Poshta branch for delivery.
2. 4.2. The Buyer pays for the order in accordance with the selected payment method and the payment terms posted on the Website. Payment is considered completed when funds are credited to the Seller’s account. The Goods may be received only after placing an order on the Website and full payment.
3. 4.3. Order confirmation specifying the delivery and payment terms selected by the Buyer is sent to the Buyer via email and/or SMS to the contact number provided.
4. 4.4. For electronic content, the website administration does not issue refunds. Electronic books are not subject to return or exchange. If the Buyer has paid for access to download Content but cannot download it due to reasons arising on the Buyer’s side, no refund is issued and the Content is deemed properly delivered. A refund is possible only if the Seller provided a non-working file that cannot be reproduced or saved (as confirmed after verification) and replacement is not possible. Content of proper quality is not subject to return or exchange.

5. Rights and obligations of the parties

5.1. The Buyer has the right to:

1. 5.1.1. Receive information about the Goods.
2. 5.1.2. Choose a payment method from those offered on the Website.
3. 5.1.3. Refuse to purchase the Goods before payment, which terminates this Agreement with respect to that order.
4. 5.1.4. Receive the Goods under a properly placed and paid order.
5. 5.1.5. No refunds are provided for electronic content; electronic books are not subject to return or exchange.

5.2. The Buyer is obliged to:

1. 5.2.1. Carefully review the Agreement terms, purchase, payment, delivery, return, and warranty conditions posted on the Website.
2. 5.2.2. Provide accurate and complete information when placing an order and bear full responsibility for such information.
3. 5.2.3. Pay the full amount of the order.
4. 5.2.4. Inspect the Goods upon receipt.

6. Warranty service

1. 6.1. Warranty service is not provided for electronic content.

7. Features of purchasing electronic content

1. 7.1. Electronic content is provided by granting download access after prepayment.
2. 7.2. Payment for electronic content is made only by payment card.
3. 7.3. Electronic content is not subject to exchange or return.
4. 7.4. No warranty obligations apply to electronic content.
5. 7.5. Electronic content is provided “as is”.

8. Liability

1. 8.1. The Seller is not liable for damage during delivery caused by the delivery service.
2. 8.2. The Seller is not liable for losses resulting from misunderstanding product information.
3. 8.3. The parties are released from liability due to force majeure circumstances.
4. 8.4. The Seller is not responsible for the functionality or security of communication channels used by the Buyer.

9. Personal data

1. 9.1. The Buyer consents to the collection and processing of personal data.
2. 9.2. Data processing is carried out in accordance with Ukrainian law and the Privacy Policy.

10. Term of the Agreement

1. 10.1. The Agreement comes into force from the moment the order is placed and is valid indefinitely.

11. Changes to the Agreement

1. 11.1. The Seller may change the Agreement at any time by publishing a new version on the Website.

Exchange and returns

Refund terms for goods

To request a return, the Buyer must submit an application and present a passport. Funds are refunded within five business days. Electronic content is not subject to return or exchange.
